A juvenile found to be carrying 560 ecstacy tablets avoided prison and a criminal record following an appeal, represented by Joseph Harb.

A 17 year old from Sydney had been convicted and sentenced to juvenile detention for the supply of 560 ecstacy tablets and $2000 woth of proceeds of crime.  Large quantities of ecstacy are considered to be of a large commercial quantity of prohibited drugs, and as such carry severe penalties. 

The young man decided to appeal the decision given the harsh sentencing having criminal lawyer Joseph Harb appear at the appeal to represent his case.  

At the appeal Mr Harb successfully convinced the judge to remove the prior imposed juvenile detention sentence and issue a Section 10 – No Conviction.  Mr Harb argued that a prison sentence was not appropriate for the young man and that no conviction should be recorded in order for him to avoid a criminal record which would have a huge impact on the mans life.   

As a result, the judge agreed and set aside the prison sentence as well as issued the no conviction requested. 

This is a huge win for the defendant and Australian Criminal Law Group.   The quantity of prohibited drugs the boy was found with were far greater than what would be deemed a large commercial quantity of drugs.    Large commercial quantity of prohibited drug carries the most severe prison sentence.

Nott surprisingly the clients family was more than thrilled with the results, showing their appreciation by lavishing Mr Harb with gifts at the end of the proceedings. Mr Harb declined, saying it was part of his job and he was happy to have helped.
