How do I get a private criminal lawyer for my Legal Aid case?
Legal Aid usually uses its own in-house criminal lawyers to represent clients. However, in limited cases, Legal Aid may assign cases to private criminal lawyers. We can obtain a Legal Aid grant on your behalf in several ways. These include:
- Applying online for Legal Aid on your behalf. This involves us asking you questions to complete an online application that we submit.
- You apply for Legal Aid yourself and nominate us as your criminal lawyers.
- Legal Aid requests that we accept your case and agree to be your criminal lawyer.
- Another private criminal lawyer representing you on Legal Aid transfers your case to us.
To obtain Legal Aid, you will need to pass a merit test. You may be eligible for legal aid if:
- You are getting a Government Allowance (e.g. New Start, Disability Support Pension, Single Parent Pension, Youth Allowance).
- You are in custody, or
- You are receiving a very low income.
